District Attorney Mark Hurlbert is in a very sensitive situation. He was
appointed to his position several years ago by Governor Bill Owens. Mark
Hurlbert was appointed to the Office of District Attorney in the Fifth
Judicial District. Hurlbert filled a vacancy caused by the resignation of
District Attorney Michael Goodbee.

Governor Bill Owens was responsible for filling the district attorney
vacancy, because a sitting district attorney resigned before the elected
term had expired. The Governor appointment Mark Hurlbert and the term of
this appointment will be until the next general election in 2004. The
vacancy will then be filled by election.

In my opinion it would have been very difficult for DA Hurlbert not to have
filed charges on Kobe Bryant. I believe it would have been political
suicide. The sad thing about this whole situation is that Da Hurlbert now
must aggressively move forward in this very high profile case, and in the
process Kobe Bryant is virtually fighting for his life.

Those accused of rape have rights, too

Running for political office, just as what many had predicted as the true reason why such a flimsey rape case gets docketed in court. Normally, the case is so weak, it gets screened out early in the process by the District Attorney's Office. Not an good strong case for prosecution. This case would not have made it through an objective DA's office, had the cops, sheriffs and detectives conducted a thorough investigation on both sides. First, comparing the two backgrounds, NO ONE has any bad words about Kobe the player, the person and those who know him. The detectives had no problem knowing the credibility of Kate with two attempted suicides within months at a nearby hospital and mental center. A routine inquiry would have disclosed that inside their own report, making it difficult to take any uncorroborated charges stick in court. Kate has too many personal issues staring in own face. A lie detector test would have flushed it out quickly.
